New York State Cell Phone Use While Driving Violations.

VTL 1225-c: Use of a Mobile Telephone: If you receive a 1225-c ticket, the police officer alleges that you were talking on a cell phone the time you were observed.

VTL 1225-d: Use of Portable Electronic Devices (includes texting while driving). If you receive a 1225-d, it is irrelevant whether you were engaged in a call or not. If you were texting or using an app, you can be given a 1225(d) ticket.

Most people don't realize that a 1225-d ticket can be given for a device other than a cell phone. GPS, MP3 player, camera, or any other hand-held device is also covered under VTL 1225-d.

The fines for getting a VTL 1225-c or 1225-d can be up to $150. If you have a New York State drivers license and are convicted of driving while using a cell phone or texting while driving, the New York State Department of Motor Vehicles will add 5 points onto your license. If you receive 11 points in an 18 months, your license will be suspended. What you need to know is that you can challenge your ticket, beat the charge, or have the charge reduced.
